Assumptions

  1. The terms used in this privacy statement and defined in the General Data Protection Regulation (AVG) have the meaning assigned to them in the AVG Act.
  2. We use the personal data only for the purposes described in this privacy statement (basis). That is lawful and transparent.
  3. We articulate our privacy statement in clear and clear language and do not attempt to hide any information. We are also clear about what data we process and how we do it. That is definite and clear.
  4. We only process the personal data that we really need. That is data minimization.
  5. We are happy to work with you to ensure that the data that we process is always correct and up-to-date. That is the accuracy of the data.
  6. We do not store the data longer than necessary to achieve the purposes for which your data is collected. That is the retention period.
  7. We never share the personal data with other parties, inside or outside the EU without good reason. We also ensure proper protection of personal data by taking many technical and organizational measures. When we share your personal data with third parties, we state this explicitly. Herman Gerrits only shares your personal data with third parties with your permission, if this is necessary for the execution of the agreement or to comply with a possible legal obligation. We conclude a processing agreement with parties that process your data on our behalf to ensure the same level of security and confidentiality of your data. Herman Gerrits remains responsible for these processes. This is for the integrity and security of the data.
Personal data that we process

Below you will find an overview of the personal data, goals, principles and retention periods that we process per category. We also indicate per category with whom your data is shared.

Customer data

Personal data and goals:
  1. Name and address details (first name, last name, address, zip code, city, country)For the implementation of the agreement, invoicing, identification, maintenance of the customer relationship and the execution of direct marketing activities.
  2. Contact and additional personal data (e-mail address, telephone number, gender)
    To communicate with each other, to address you correctly, to provide support, to inform you of changes in products / services, to perform direct marketing activities.
  3. Payment details (bank account number, VAT number)
    To process your payment and for the VAT transfer if your company is located outside the Netherlands.
Basis (legal basis) for processing:
Necessary for the implementation of the agreement (click here for more information).
Conducting direct marketing activities (we send you offers of comparable products or services or tips about the products or services purchased) fall under “legitimate interest” (click here for more information).

Retention period:
Up to one month after the termination of the agreement. We store your invoices for the legal retention period.

With whom is your information shared:
With our bookkeeper and our accounting software supplier. They are processors or sub-processors and we have entered into a processing agreement with them.

Data from website visitors
Herman Gerrits uses cookies. A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you first visit this website. You can change cookie preferences by following these instructions. In addition to cookies, this website contains one or more web forms in which personal data are processed.

Herman Gerrits uses cookies purely for functionality. These ensure that the website works properly and that, for example, your choices and preferences are remembered.

Analysis of cookies

Personal data and goals:
When you visit this website we process your (anonymous *) IP address in our statistics to gain insight into how our website works and to improve it. * = For this processing we anonymize your IP address before it is processed by the statistics software Google Analytics; this means that it is no longer personal data.

The maximum retention period for Google Analytics cookies is set by us at 26 months.

With whom is your information shared:
With us and Google. We have set the Google Analytics cookies in a privacy-friendly manner in accordance with the 'Privacy-friendly settings of Google Analytics' manual as made available by the Dutch Data Protection Authority. For the Google Analytics cookies, this means that Herman Gerrits i) has concluded a processing agreement with Google, ii) masks the last octet of your IP address, iii) has switched off 'sharing data' so that Google cannot use the personal data obtained for its own purposes (Google can only use this for technical support) and iv) does not use other Google services in combination with the Google unless otherwise indicated in the 'Marketing & tracking cookies' section. Marketing & Tracking Cookies

This website does not use any marketing or tracking cookies. That is why this website has no cookie notice.

Web forms

Personal data and goals:
For example, you can contact us via a web form. Each web form has one clear purpose and if a form contains an extra purpose (for example, registering for the newsletter) then we will ask for extra permission. By completing the form you give us permission to process the requested personal data. For this we mainly use name and address details, the telephone number and an e-mail address.

Basis (legal basis) for processing:
Permission that is given by filling in the form or ticking the giving of permission for an extra purpose (click here for more information). You can withdraw your consent by passing this on via the relevant web form or by sending an e-mail to info@hermangerrits.nl.

Retention period:
We keep the data until we are sure that you are satisfied with our response. If the contact leads to an assignment, we will save the information up to one month after the termination of the contract (at the latest). We save your invoices for the legal retention period.

With whom is your information shared:
With us and GraagGoedOnline.nl BV, our online supplier. We have entered into a processing agreement with GraagGoedOnline.nl BV (Click here for more information).

Special and / or sensitive personal data that we process
Our website and / or service does not intend to collect data about visitors who are younger than 16 years old. Unless they have permission from parents or guardian. However, we cannot check whether a visitor is older than 16. We therefore advise parents to be involved in the online activities of their children, to prevent data about children being collected without parental consent. If you are convinced that we have collected personal information about a minor without that permission, please contact us at info@hermangerrits.nl, we will remove this information.

Automated decision making

Herman Gerrits takes decisions on matters that may have (significant) consequences for individuals on the basis of automated processing. These are decisions that are made by computer programs or systems, without a human being (such as a Herman Gerrits employee) among them.

View, modify or delete data
You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your consent for data processing or to object to the processing of your personal data by Herman Gerrits and you have the right to data transferability. This means that you can submit a request to us to send the personal data that we hold about you in a computer file to you or another organization mentioned by you.


We will respond to your request as quickly as possible, but within four weeks. Herman Gerrits would also like to point out that you have the possibility to file a complaint with the national data protection authority, the Dutch Data Protection Authority. If you have a complaint about how we or our sub-processors handle your personal data, we ask you to first discuss this with us, so that we can see if we can resolve or adjust it to your satisfaction. If we cannot come to that point, you can always submit a complaint to the regulator.

How we protect personal data
Herman Gerrits takes the protection of your data seriously and takes appropriate measures to prevent abuse, loss, unauthorized access, unwanted disclosure and unauthorized changes. If you feel that your data is not properly protected or there are indications of abuse, please contact us via info@hermangerrits.nl.

Both we and our suppliers (processors) will endeavor to take appropriate technical and organizational measures with regard to the protection of personal data. We do not guarantee that the protection will be effective under all circumstances. We will endeavor to ensure that the security meets a level that is not unreasonable in view of the state of the art, the sensitivity of the Personal Data and the costs associated with taking the security.

Changes to this privacy statement
Herman Gerrits reserves the right to make changes to this privacy statement. Changes will be published on this website. Therefore, check this privacy statement regularly so that you are aware of any changes. The latest version is displayed in the "Last Modified" section. If you continue to use our website after the last change, this means that you acknowledge, approve and agree to these changes to this privacy statement.
